Motor Vehicle Accidents
If a person is injured as a result of a motor vehicle, they are entitled to compensation. The compensation is paid pursuant to the certificate of registration that all motor vehicles are required to have. When paying the fees to register a motor vehicle, the greater proportion of the registration money is actually put towards an insurance policy to protect anyone who might be injured in a motor vehicle accident.
In addition to passengers or pedestrians, even the driver of a motor vehicle can be entitled to compensation is the accident was caused by the fault of another driver.
In deciding what compensation is payable, the first matter that must be decided is who is responsible for the accident and in what proportion. For example, was the driver 20% responsible or 80% responsible (etc.)? The next decision to be made is how much the compensation is worth. For example, is the claim worth $10,000.00 or $100,000.00? Once the amount of compensation has been decided, then the percentage is applied to that figure.
Accordingly, if a person’s injuries are calculated to be worth $50,000.00 and the driver is found to be 10% in the wrong, then the driver would receive 90% of $50,000.00 for their claim. Obviously, if the person is a passenger, they would usually be entitled to 100% of their claim. If you are able, you should try to:-
- Draw a plan of how the accident happened
- Take a photograph of the damage to your motor vehicle
- Keep all your medical accounts and chemist receipts
- Maintain a diary detailing how you have been affected by the injury
- Take photographs of any scarring
Slip & Fall Accidents
If you suffer an injury as a result of a fall by tripping over something in a public place, you may be entitled to compensation. It is critical in such cases to take a photograph if you can of whether the accident happened and what caused you to trip and fall or to show how the accident occurred.
